1. Introduction And Scope
Locus Lock, Inc. (“Locus Lock,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect personal information in connection with our websites and our online store, currently located at locuslock.com (collectively, the “Site”), and in connection with orders for Locus Lock products placed through the Site. This Privacy Policy does not apply to the practices of third parties that we do not own or control, including the third-party websites and services described in Section 13. Your purchase and use of Locus Lock products are governed by our Evaluation Kit Terms and Conditions or other written agreement between you and Locus Lock, and if there is a conflict between such agreement and this Privacy Policy with respect to product data, the agreement controls.
2. Information We Collect
We collect the categories of information described in this Section.
2.1 Information You Provide To Us
When you place an order, create an account, request a quote, sign up for communications, or contact us, we may collect your name, company or organization name, job title, email address, telephone number, billing and shipping addresses, order details, account credentials, and the contents of your communications with us. We do not ask you to provide, and you should not submit through the Site, sensitive personal information such as government identification numbers or health information.
2.2 Information We Collect Automatically
When you visit the Site, we and our service providers may automatically collect information about your device and how you interact with the Site, such as IP address, browser type, operating system, device identifiers, pages viewed, links clicked, referring pages, and the dates and times of your visits. We collect this information through cookies and similar technologies, as described in Section 5.
2.3 Information We Receive From Third Parties
We may receive information about you from our e commerce platform provider, payment processors (such as order confirmation and fraud prevention signals), shipping and logistics providers, restricted-party and sanctions screening services, and business partners or resellers, and we may combine that information with information we collect directly.
2.4 Product Compliance Data
As described in our Evaluation Kit Terms and Conditions, Locus Lock products include license management and export-control compliance functionality and, when connected to the internet, may periodically transmit to Locus Lock the license key associated with the product, license status and expiration information, and encrypted, reduced precision geographic location information (for example, city, state or province, and country, and not precise GPS coordinates). The products are not designed to transmit usernames, passwords, passkeys, personally identifiable information, customer files, mission data, or navigation history to Locus Lock. Locus Lock servers may also log metadata associated with product communications, such as the public IP address from which a product connects, and we may associate this information with your account information (such as name, email address, and organization) for customer logging and observability purposes. We do not sell this information, and we do not disclose it to third parties except to service providers assisting us with these purposes or as required by applicable law. To the extent this information is associated with an identifiable individual, such as through your account, we handle it in accordance with this Privacy Policy and use it only for the purposes described in Section 3.
3. How We Use Information
We use the information described in Section 2 to: (1) process, fulfill, and deliver your orders, including delivering software and license keys through your account; (2) create and administer your account; (3) process payments and prevent fraudulent, unauthorized, or unlawful transactions; (4) comply with export-control, sanctions, and other legal obligations, including conducting restricted-party screening and maintaining compliance records; (5) manage and enforce software licenses, including through the license verification functionality described in our Evaluation Kit Terms and Conditions, and maintain related customer logging and observability records; (6) provide customer support and respond to your inquiries; (7) operate, maintain, secure, and improve the Site and our products and services; (8) send you transactional communications about your orders and account and, where permitted by law and subject to your right to opt out, marketing communications about our products; (9) enforce our agreements and protect our legal rights; and (10) comply with applicable law.
4. How We Share Information
We share the categories of information described in Section 2 as follows: (1) with service providers that perform services on our behalf, such as our e-commerce platform provider, payment processors, shipping and logistics providers, cloud hosting providers, analytics providers, email providers, and screening services, in each case for the purposes described in this Privacy Policy; (2) with our professional advisors, such as lawyers, accountants, and auditors; (3) with government authorities or other parties where we believe disclosure is required by law or legal process, including in connection with export-control, sanctions, and other regulatory obligations; (4) where we believe disclosure is necessary to protect the rights, property, safety, or security of Locus Lock, our customers, or others, or to detect, investigate, or prevent fraud or security issues; (5) in connection with an actual or contemplated merger, acquisition, financing, reorganization, or sale of all or a portion of our business or assets, in which case personal information may be transferred as part of the transaction; and (6) with your direction or consent. We do not sell personal information, and we do not share personal information for cross-context behavioral or targeted advertising.
5. Cookies And Similar Technologies
We and our service providers use cookies, pixels, and similar technologies to operate the Site, remember your preferences and cart contents, keep you signed in, understand how the Site is used, and improve the Site. Some of these technologies are necessary for the Site and checkout to function. You can manage cookies through your browser settings, and most browsers allow you to refuse or delete cookies, although disabling cookies may affect the availability or functionality of parts of the Site, including checkout. To the extent required by applicable law, we honor opt-out preference signals such as the Global Privacy Control.
6. Payment Processing
Payments made through the Site are processed by third-party payment processors. Your payment card or other payment information is submitted directly to those processors, and we do not receive or store full payment card numbers. Payment processors handle your payment information in accordance with their own terms and privacy policies, and we encourage you to review them.
7. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including for as long as you maintain an account or an active software license, and thereafter as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Records relating to export-control compliance, including order and screening records, are retained for at least the period required by applicable export-control laws, which is generally five years. In determining retention periods, we consider the nature and sensitivity of the information, the purposes for which we process it, and applicable legal requirements.
8. Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. No method of transmission over the internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security.
9. Your Choices
You may opt out of marketing emails at any time by using the unsubscribe link included in those emails or by contacting us as described in Section 15. Even if you opt out of marketing communications, we will continue to send you transactional messages relating to your orders, your account, and your licenses. You may access and update certain account information by logging into your account, and you may manage cookies as described in Section 5.
10. Your Privacy Rights
Depending on where you live, applicable law (such as the Colorado Privacy Act or the California Consumer Privacy Act) may give you rights with respect to your personal information, including the right to know or access the personal information we hold about you, the right to correct inaccurate personal information, the right to delete personal information, the right to obtain a portable copy of personal information, and the right to opt out of the sale of personal information, the sharing or processing of personal information for targeted advertising, and certain profiling. We do not sell personal information or process it for targeted advertising. To exercise any right available to you under applicable law, contact us as described in Section 15. We may need to verify your identity before responding to your request, and you may use an authorized agent to submit a request where applicable law permits. We will not discriminate against you for exercising your rights. If we decline to take action on your request, you may have the right under applicable law to appeal our decision by contacting us with the subject line “Privacy Appeal.”
11. International Users
Locus Lock is located in the United States, and the Site is operated from the United States. If you access the Site or place an order from outside the United States, your information will be transferred to, stored in, and processed in the United States and other jurisdictions that may not provide the same level of data protection as your home jurisdiction. Where the data protection laws of the European Economic Area, the United Kingdom, or Switzerland apply, we process personal information as necessary to perform our contract with you, to comply with our legal obligations (including export-control obligations), for our legitimate interests in operating, securing, and improving our business, or with your consent, and you may have additional rights under those laws, including the right to lodge a complaint with your local supervisory authority.
12. Children's Privacy
The Site and our products are intended for business and professional users and are not directed to children under the age of 16. We do not knowingly collect personal information from children under 16, and if we learn that we have done so, we will delete that information.
13. Third-Party Websites And Services
The Site may contain links to third-party websites and services, and portions of the Site, including checkout, are operated using third-party platforms. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party websites and services you use.
14. Changes To This Privacy Policy
We may update this Privacy Policy from time to time. If we make changes, we will post the updated Privacy Policy on the Site and update the effective date above, and if we make material changes, we will provide additional notice as required by applicable law, such as by email or by a prominent notice on the Site. Your continued use of the Site after the effective date of an updated Privacy Policy means that the updated Privacy Policy applies to you.
